1. Acceptance of Terms
By downloading, accessing, or using the BodyTrackr mobile application (the "App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
You must be at least 13 years old to use the App. If you are between 13 and 18 years old, you may only use the App under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
2. Description of Service
BodyTrackr is a fitness tracking application designed to help users document their personal body transformation journey. Key features include progress photo capture, weight and measurement logging, and automated transformation video generation.
A core principle of the App is data privacy: all user-generated data (photos, weight logs, etc.) is stored locally on the user's device and is not uploaded to any external servers by BodyTrackr. The App may offer optional ad-supported features to support its development and maintenance.
3. User Responsibilities
- You agree to use the App for personal, non-commercial purposes only.
- You are solely responsible for the security of your device and for maintaining backups of any data stored by the App on your device. Since data is stored locally, BodyTrackr cannot recover lost data.
- You must not attempt to reverse engineer, decompile, disassemble, or otherwise modify the App or any part thereof.
- You are responsible for ensuring that your use of the App complies with all applicable local, state, national, and international laws and regulations.
4. Privacy and Data
Your privacy is important to us. Our data handling practices are detailed in our Privacy Policy, which is an integral part of these Terms. Please review the Privacy Policy to understand how we handle information.
You acknowledge and agree that all personal data, including photos and measurements, entered into the App is stored solely on your local device. BodyTrackr does not have access to this data. Consequently, if you delete the App, lose your device, or your device is damaged, your data may be permanently lost unless you have independently backed it up.
5. Intellectual Property
The BodyTrackr App, including its design, "look and feel," source code, branding, logos, and all related content (excluding User Content), are the exclusive property of BodyTrackr and its licensors, protected by copyright, trademark, and other intellectual property laws.
You retain all ownership rights to the content you create and store within the App, such as your photos, videos generated from your photos, and personal measurement data ("User Content"). By using the App to generate videos, you understand that these videos are created on your device from your User Content and belong to you.
6. Prohibited Uses
You agree not to use the App to:
- Store, display, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or racially, ethnically, or otherwise objectionable.
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App, or any server, computer, or database connected to the App (though the App primarily operates locally).
- Engage in any activity that interferes with or disrupts the App or its underlying technology (e.g., by introducing viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful).
- Use the App for any commercial purpose or for the benefit of any third party without our express prior written consent.
7. Disclaimers
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
BODYTRACKR IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE. The App is intended for informational and tracking purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or fitness program. Never disregard professional medical advice or delay in seeking it because of something you have read or tracked on the App.
RESULTS MAY VARY. BodyTrackr makes no guarantees concerning the level of success you may experience, and you accept the risk that results will differ for each individual. We are not responsible for any health problems that may result from training programs, consultations, products, or events you learn about through the App.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BODYTRACKR, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
SINCE ALL USER DATA IS STORED LOCALLY ON YOUR DEVICE, BODYTRACKR SHALL NOT BE LIABLE FOR ANY LOSS OR CORRUPTION OF DATA. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (WHICH IS CURRENTLY FREE).
9. Ad Services
The App may include optional rewarded video advertisements provided by third-party ad networks such as AppLovin MAX and Unity Ads. By choosing to view these ads, you acknowledge that these third-party networks may collect and use data according to their own privacy policies and terms of service. BodyTrackr is not responsible for the content or practices of these third-party ad services. You can typically opt out of personalized advertising through your device settings.
10. Termination
These Terms are effective until terminated by either you or us. You may terminate these Terms at any time by uninstalling the App from your device.
We may terminate or suspend your access to the App, in our sole discretion, at any time and without notice or liability, if you breach these Terms.
Upon termination, all rights and licenses granted to you in these Terms will immediately cease. Provisions of these Terms that, by their nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Geographic Restrictions
The App is intended for use by individuals located in the following countries: United States, Canada, United Kingdom, Australia, New Zealand, and India. We make no representation that the App is appropriate or available for use in other locations. If you access the App from other locations, you do so at your own risk and are responsible for compliance with local laws.
12. Changes to Terms
We reserve the right, in our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice, such as through the app store listing or an in-app notification, prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the App.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court, except that you may assert claims in small claims court if your claims qualify.
